If the washington Supreme Court sides with us it will be appealed by another school in another state. Yeah, this will be ugly for a while. Maybe it is in our best interests to keep this tied up until August... This. At some point, these schools need their money for this year. From what I can tell, because of the existing stay and TRO, any distributions need a unanimous agreement, which means we can block it. What happens if August 4th arrives and all that media money is still sitting there? My bet is nobody knows. Once again, the most logical path forward is a settlement; the T10 can simply agree to give up 30% of this year's revenue as damages, take their 70%, and be happy they got that much. But these are bad actors who don't care about logic, only greed, as proven by the current state we find ourselves in. The lawyers are gonna rake it in on this one.... |

hopefully the justices agree to hear our 'request they remove the stay'. It sounds like that can happen before Dec 12. We really need a decision prior to the portal opening.

If the Washington Supreme Court sides with us it will be appealed by another school in another state. It can't. Full faith and credit. Another state cannot appeal another state's Supreme Court's ruling on an issue, unless there is some kind of jurisdictional or procedural argument. That is why I thought that it should be brought in Benton or Whitman Counties originally. If the full Washington Supreme Court makes a ruling, the only appeal would be to the United States Supreme Court. If we lose at some point, there may be some kind of cross-appeal. I could see that, but if the United States Supreme Court rules on it, it cannot be relitigated. |
