Definition of "bust" is highly open to interpretation. Chris Davis certainly struggles at the plate, but he is there to play and potentially help your team. $ for $ he's less a bust than a guy collecting a paycheck for the better part of three (will be 4 in 2020) seasons doing nothing to help the team win. Not that the Orioles win... Chris Davis is not potentially helping his team. He's terrible and they're only playing him because they are paying him so much and they feel obligated to play him. If you're producing stats you're are potentially helping vs sitting at home.

In fact, he was so bad he actually crossed the threshold from we feel obligated to play you every day to.. uh, Chris, let's sit this one out today - and was down 170 ABs compared to the previous year. I still have JaMarcus Russell as my #1 bust in the last 20 years though.

Chris Davis has been so bad the past 3 years that he's actually hurting his team. He's compiled a 0 or negative WAR over each of the last 3 years. Jacoby Ellsbury LITERALLY did more to help the Yankees win in 2018-19 than Chris Davis did to help the Orioles. Davis will earn another $69 million over the next 3 years, and if the Orioles were smart, they'd cut him and pay him to not make their team worse.

Jacoby did not hurt the Yankees this year. He did not take up a spot in the lineup, on the 25-man active roster, or on the 40-man MLB roster, since he was on the 60-day IL. The Yankees could play a productive player in his place.
And as the richest franchise in MLB, they easily had the money to pay him, under the terms of his contract, which they willingly agreed to many years ago. So unless you want to undo centuries of contract law, Jacoby was fully entitled to the compensation he received.
Davis did hurt the Orioles this year, and in fact has hurt them considerably over the last several seasons by being a wholly unproductive spot in the lineup while sucking up millions from a franchise with dwindling resources thanks to a monumental decline in home attendance.
I don't consider players whose careers were ended by injury as "busts." He could not contribute because of physical reasons. Was Ernie Davis a first-round "bust" because he died before he ever played a down for the Browns?
Chris Davis was healthy enough to contribute, but didn't because he just sucks. He's a bust.
And the Yankees are not going to win a lawsuit against the Players Association. That's not happening.

When someone literally "busts their butt" trying to be the best player he can be, and his contract is what it is, then he ought not to be penalized because of it. The Yankees and Jake both signed in good faith, and this joke of a claim that he got unsanctioned medical treatment (because what the team was providing was obviously so successful) is a joke that not many arbitrators will give a lot of weight to. There will be some sort of settlement, but the Yankees rational for it is laughable.
