none of us would know anything if the Benton County Sheriff hadn't f%#*ed up. So there's that. Luke Heimlich's attorney successfully argued that, because Heimlich was a student, he was not an Oregon resident, so the particular law did not apply to him, which is a great argument to make. However, it is hard to fault the Benton County Sheriff from enforcing the law on an individual, who had lived in the State of Oregon for three years at that point and was not living on campus. The residency surrounding out-of-state students often are very complicated. I personally would rather the Benton County Sheriff's department error on the side of public safety, but I am a kook. If Heimlich had chosen to go to school at pretty much any other school, he would probably be pitching in the Majors now. I must stress that it is always important to hire a great lawyer from the get-go. And when you have a totally messed up legal history, because of a previous poor attorney, a great attorney can help you avoid the situation that Heimlich found himself in. Assuming Luke is innocent (despite his not contesting the charges), the villains are not the BCS Dept or the Oregonian or OSU. The villains would be his own dysfunctional immediate family who (again, assuming LH is innocent) framed him for a despicable crime he didn’t commit and placed him in a horrible no-win situation.

If he was innocent, there’s no way I would ever tell my kid to plea to that…..shoplifting, maybe…. but not sexually assaulting a relative. I’d rather him get wrongfully convicted then ever having my child admit to that if they didn’t do it. Attorneys on this board may disagree with me, but I don’t care.

If there is anyone else, it is his idiot attorney, who told him to twice admit to something that he did not do and then had him admit to the later allegation, which is the only one that could get him in trouble with the Benton County Sherriff.

It is one of those legal fiction things, though. He physically resided in Oregon for most of the year. 99+ times out of a 100, you want the Benton County Sherriff to make sure that child sex offenders are 100% complying with Oregon law. People get errantly-cited for things all of the time. Usually, though, the errant citation does not tip off a regional newspaper that you twice admitted that you sexually assaulted your niece. In addition to the foregoing, if this all does not happen, there is about a 1% chance that Oregon State wins the National Championship in 2018. So, I still do not get all of the hysteria from Oregon State fans about something that may or may not have happened in 2012.
